Case filed in the middle district of Florida case number 6:10-CV-349-ORL-28-GJK and James Adamczyk and Mark Adamczyk have named seventeen defendants that include Morgan Stanley, General Motors, Chrysler, Jack Hutchings, David H. Simmons, and two Seminole County Court Judges.
Federal Judges will only hear certain cases; the majority of other cases are heard in State courts in Florida. However, the claims that have been brought by Mark Adamczyk and James Adamczyk have a significant purpose for being in federal court. Civil RICO, Violation of Constitution, False Imprisonment, and Fraud and Tax evasion are just some of the claims that name seventeen defendants in the case. The case reads something like a New York Times Bestseller. The 44 page suit has such names as Dan Marino and Darius Rucker all partying with General Motors and Morgan Stanley executives in Costa Rica. There are allegations that US Taxpayers bail out money to GM, Chrysler and Morgan Stanley was used on prostitutes in Costa Rica. James Adamczyk, who was Jack Hutchings business partner and confidant for about twenty years, brought the suit, under the new IRS Whistleblowers law signed by President Bush in Dec. 2006, against his former boss and partner, after refusing to participate in Hutchings illegal activity. James L.(Jack) Hutchings a 1990 Horatio Alger award winner, who made a four hundred million dollar fortune in the automobile industry, Has been accused of transporting minors from Colombia to Costa Rica as young as 11 years old for sexual purposes. After witnessing this illegal activity Adamczyk fled Costa Rica. Adamczyk also alleges that Hutchings runs an all cash helicopter and fishing boat charter business in Costa Rica that goes unreported to the Internal Revenue Service. Additionally, Adamczyk says he has witnessed Hutchings Chief Financial Officer falsify FAA flight logs to create false deductions to defraud the IRS of multi-millions of dollars. The suit brings in David H. Simmons, an Orlando lawyer with deBeaubien, Knight, Simmons, Mantzaris & Neal, LLP as a Defendant and co-conspirator along with Judge Alan A. Dickey and Judge Nancy F. Alley of Seminole County Court. They are strictly in the lawsuit for an alleged scheme to defraud Mark Adamczyk out of his constitutional rights. James Adamczyk who has a non-disparaging settlement agreement with Jack Hutchings, was originally sued by Jack Hutchings for breach of contract. James Adamczyk made a Youtube.com video asking Jack Hutchings to end their dispute like men. However, Jack Hutchings had something different in mind and now has spent nearly a million dollars to David H. Simmons to uphold a settlement agreement that paid James Adamczyk just $125,000 for over $2,000,000 dollars worth of assets the lawsuit states. James Adamczyk who alleges he was under duress and was threatened with physical violence to sign the settlement agreement, alleges that Judge Nancy F. Alley was corrupt in her rulings while having an improper relationship with David Simmons. Judge Nancy F. Alley has since recused herself from the case. However, before she recused herself she signed orders that extend the settlement agreement to James Adamczyk son, Mark Adamczyk. Mark Adamczyk, who in no way ever signed a settlement agreement with Hutchings, has now had three of his own websites shut down with the court orders drawn up by Judge Nancy F. Alley. Judge Alan A. Dickey who took over the case after Judge Alley recusal refused to look over Mark Adamczyk motions and actually went so far as to put James Adamczyk in prison for 5 months for one blog post on the internet under civil contempt and threatened Mark Adamczyk with prison as well. For these actions, Mark Adamczyk and James Adamczyk say they have no other remedy available to them and their constitutional rights as an American citizen then to bring this in front of a Federal court and pray that can provide justice. The fifty million dollar Federal Lawsuit filed as a Federal RICO claim also alleges Hutchings promised to give the Grand Blanc, Mi. company to itís employees including Adamczyk and promised UAW workers he would never sell out there jobs in Michigan. Once the UAW agreed to a contract, Hutchings designed a scheme with the help of bribed General Motors and Chrysler executives to put 600 UAW workers out of work and move the operation to Costa Rica. Where Hutchings is involved in prostitution, pornography, tax evasion and Money Laundering the suit goes on to say.
